  3. PROFESSOR IRIS' ANIMAL SAFARI CD-ROM      (Macintosh)

  7. Professor Iris' Animal Safari requires:
  8. • Minimum 8MB of available RAM
  9. • System software 7 or greater
  10. • Minimum 13” color monitor with at least 256 colors
  11.  
  12. The installer provided on this CD-ROM will install QuickTime 2.0 and Sound 
  13. Manager 3.0. Within the installer, you may choose to install QuickTime only, 
  14. Sound Manager only, or both.
  15.  
  16. QuickTime is required to run Professor Iris' Animal Safari, and we recommend 
  17. that you use the version of QuickTime that comes with your CD-ROM. Installing 
  18. Sound Manager 3.0 will improve audio quality but is not required for running 
  19. Professor Iris' Animal Safari. Remember to restart your Macintosh after 
  20. installation.

  22. Note: If you already have QuickTime installed on your Macintosh, and do not wish 
  23. to install Sound Manager 3.0, you do not need to run the installer. Just double-
  24. click on the program icon for the language of your choice to get started.

  26. We recommend turning off any screensavers when using this product.
  27.

  32. To use the installer:
  33. Double-click on the icon labelled "Install". Choose "Install Everything" to install 
  34. both Sound Manager and QuickTime, "Install QuickTime Only" to just install 
  35. QuickTime, or "Install Sound Mgr. only" to only install Sound Manager. These 
  36. files need to be installed on the hard drive which contains your System folder. 
  37. To change the drive shown, click on the button labelled "Drive". If a dialog box 
  38. appears asking for permission to perform an operation, grant permission; this 
  39. may be due to virus protection software running on your machine.
  40. Click the "Quit" button to quit when the installation is finished, and restart your
  41. computer before starting your CD-ROM.

  71. Discovery Communications, Inc. LICENSE

  73. 1. GRANT OF LICENSE:  This Discovery Communications, Inc. License Agreement 
  74. (“License”) permits you to use one copy of the specified version of the 
  75. Discovery Communications, Inc. product identified above (“SOFTWARE”, which 
  76. includes at least one CD-ROM disc or may include one or more floppy disks) on 
  77. any single computer, provided the SOFTWARE is in use on only one computer at a 
  78. time. The SOFTWARE is “in use” on a computer when it is loaded into the 
  79. temporary memory (i.e., RAM) or installed in permanent memory (e.g., hard disk, 
  80. CD-ROM, or other storage device) of that computer, except that a copy installed 
  81. on a network server for the sole purpose of distribution to other computers is 
  82. not “in use”.  If the anticipated number of users of the SOFTWARE will exceed 
  83. the number of applicable Licenses, then you must have a reasonable mechanism 
  84. or process in place to assure that the number of persons using the SOFTWARE 
  85. concurrently does not exceed the number of Licenses.  If the SOFTWARE is 
  86. permanently installed on the hard drive or other storage device of a computer 
  87. (other than a network server) and one person uses that computer more than 80% 
  88. of the time it is in use, then that person may also use the SOFTWARE on a 
  89. portable or home computer.

  91. 2. COPYRIGHT.  The SOFTWARE is owned by Discovery Communications, Inc. or its 
  92. suppliers and is protected by United States copyright law and international 
  93. treaty provisions.  Therefore, you must treat the SOFTWARE like any other 
  94. copyrighted material (e.g., a book or musical recording).  You may not copy the 
  95. CD-ROM disc portion of the SOFTWARE or the written materials accompanying 
  96. the SOFTWARE.

  98. 3. OTHER RESTRICTIONS.  You may not rent or lease the SOFTWARE without 
  99. Discovery Communications, Inc.’s prior written consent, but you may transfer 
  100. the SOFTWARE and accompanying written materials on a permanent basis 
  101. provided you retain no copies and the recipient agrees to the terms of this 
  102. Agreement.  You may not reverse engineer, decompile or disassemble the 
  103. SOFTWARE.  Any transfer of the SOFTWARE must include the most recent update 
  104. and all prior versions.
  105.  
  106. LIMITED WARRANTY
  107. ________________
  108. Discovery Communications, Inc. warrants to you, the original Licensee, that the 
  109. SOFTWARE will perform substantially in accordance with the accompanying 
  110. written materials for a period of 90 days from the date of purchase.  If a disk is 
  111. defective, Discovery Communications, Inc. will replace the disk at no charge to 
  112. you, if you return the disk to Discovery Communications, Inc. at the address 
  113. below with proof of purchase within 90 days after you purchased it. Your sole 
  114. and exclusive remedy, and Discovery Communications, Inc.’s sole and exclusive 
  115. liability, will be either replacement of the disk or a refund of the purchase 
  116. price in accordance with this limited warranty.  This limited warranty gives 
  117. you specific legal rights.  You may have others which vary from state/country to 
  118. state/country.

  120. THE ABOVE WARRANTY IS THE ONLY WARRANTY OR REPRESENTATION OF ANY KIND 
  121. WITH RESPECT TO THE SOFTWARE MADE BY DISCOVERY COMMUNICATIONS, INC. OR 
  122. ANYONE ELSE INVOLVED IN THE CREATION, PRODUCTION, DELIVERY, OR LICENSING 
  123. OF THE SOFTWARE.  FURTHERMORE, ANY IMPLIED WARRANTIES WITH RESPECT TO 
  124. THE SOFTWARE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS 
  125. FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT OF THIRD PARTY RIGHTS, 
  126. ARE SPECIFICALLY DISCLAIMED.

  128. NEITHER DISCOVERY COMMUNICATIONS, INC. NOR ANYONE ELSE INVOLVED IN THE 
  129. CREATION, PRODUCTION, DELIVERY, OR LICENSING OF THE SOFTWARE MAKES ANY 
  130. WARRANTY OR REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED, WITH 
  131. RESPECT TO THE QUALITY, RELIABILITY, OR PERFORMANCE, OR THE 
  132. MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSES OF THE 
  133. SOFTWARE. THE SOFTWARE IS LICENSED “AS IS.” YOU ASSUME THE ENTIRE RISK 
  134. AS TO THE QUALITY, RELIABILITY, AND PERFORMANCE OF THE SOFTWARE.

  136. DISCLAIMER OF DAMAGES

  138. IN NO EVENT WILL DISCOVERY COMMUNICATIONS, INC. OR ANYONE ELSE INVOLVED 
  139. IN THE CREATION, PRODUCTION, DELIVERY, OR LICENSING OF THE SOFTWARE BE 
  140. LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, DIRECT, OR 
  141. INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE USE OF THE SOFTWARE, 
  142. EVEN IF DISCOVERY COMMUNICATIONS, INC. OR ANYONE ELSE INVOLVED IN THE 
  143. CREATION, PRODUCTION, DELIVERY, OR LICENSING OF THE SOFTWARE HAS BEEN 
  144. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  146. This notice will be construed, interpreted, and governed by the laws of the state 
  147. of Maryland as applied to transactions taking place entirely within Maryland 
  148. between Maryland residents.
